RECENT RELEASES - FLORIDA SUPREME COURT

RULES OF CRIMINAL PROCEDURE--AMENDMENT--PRETRIAL RELEASE. The Court adopted amendments to rule 3.131 (Pretrial Release) clarifying that a first appearance judge can revoke pretrial release on a case not assigned to that judge in accordance with section 903.0471 and that subdivision (d) of the rule relates to the removal or reduction of bail conditions, as opposed to the revocation of pretrial release. The Court also amended subdivision (h) to clarify the proper court for setting conditions of release after recommitment. The amendments become effective July 1, 2024.
VIEW OPINION

INSURANCE--PERSONAL INJURY PROTECTION--MEDICAL EXPENSES--REIMBURSEMENT RATE. The Court held that, pursuant to the terms of the PIP policy, an insurer which had provided notice that it would limit payment pursuant to the statutory schedule of maximum charges was permitted to pay 80% of a charge submitted by a provider that was for less than the amount reimbursable under the schedule. Nothing in section 627.736, Florida Statutes, invalidated the provision of the policy which expressly permitted the insurer to pay 80% of the charges submitted.
