Workers' compensation -- Hearings -- De novo -- Illegible transcript -- Cause remanded for hearing de novo, where court reporters were unable to transcribe portions of testimony and agreed that it was impossible to prepare a proper transcript

CALVIN'S HEAVY EQUIPMENT, INC. and AUTO OWNERS INSURANCE COMPANY, Appellants, v. DWIGHT JEROME KIRKLAND, Appellee. 1st District. Case No. 96-3523. Opinion filed September 18, 1997. An appeal from an order of the Judge of Compensation Claims. Michael J. DeMarko, Judge. Counsel: Millard L. Fretland and Douglas F. Miller of Clark, Partington, Hart, Larry, Bond, Stackhouse & Stone, Pensacola, for appellant. Russell R. Stewart, Panama City, for appellee.

(PER CURIAM.) The transcript of the final hearing in this workers' compensation proceeding contains over 400 instances where the court reporter was unable to transcribe portions of testimony. Another court reporter was asked to review the tape of the hearing and agreed that it is impossible to prepare a proper transcript. Accordingly, we reverse and remand the cause for a hearing de novo. Arnold Lumber Co. v. Harris, 469 So. 2d 786 (Fla. 1st DCA 1984). (BARFIELD, C.J., KAHN and DAVIS, JJ., CONCUR.)
