RECENT RELEASES - FLORIDA SUPREME COURT
FLORIDA BAR RULES--AMENDMENTS. With minor modifications, the Court adopted amendments to the Rules Regulating the Florida Bar proposed by The Florida Bar and approved by the Florida Bar's Board of Governors. The rules amended included the following: 1-3.2 (Membership Classifications), 1-3.3 (Official Bar Name and Contact Information), 1-3.7 (Reinstatement to Membership), 1-7.3 (Membership Fees), 11-1.8 (Continuation of Practice Program After Completion of Law School Program or Graduation), and 20-3.1 (Requirements for Registration). Bylaw 2-3.10 (Meetings) and Chapter 8 (Lawyer Referral Rule) were also amended.
RULES OF CRIMINAL PROCEDURE--AMENDMENT--USE OF COMMUNICATION TECHNOLOGY. The Court created a new subsection (1) to rule 3.116(c) (Pretrial Conferences) addressing the use of communication technology for non-evidentiary pretrial conferences. The rule requires a judge to grant a request to use communication technology for a non-evidentiary pretrial conference scheduled for 30 minutes or less unless the judge determines that good cause exists to deny the request.
WRONGFUL DEATH--DAMAGES--LOSS OF CONSORTIUM--SURVIVING SPOUSE. The Court held that a spouse who married the decedent after the onset of the injury that caused the decedent's death is a "surviving spouse" under section 768.21(2), and is not barred from recovering damages under the statute by the common law "marriage before injury" rule.
